The July/August 2008 issue of
Retirement Plan News starts with an article on the 401(k)
Supreme Court case Larue v. DeWolff. Although this case may open
the door to litigation, it is based on a rather serious breach
of fiduciary responsibility. The good news is that fiduciary
responsibilities have not changed, and we present and overview
of them as part of this article.
The second article addresses the new
EGTRRA opinion letters for prototype and volume submitter
defined contribution plans, the six-year cycle and interim
amendments.
Our third article presents the
Department of Labor’s guidance on the deadline for depositing
elective deferrals and loan repayments. In our recent
developments section, we present a Pension Protection Act change
effective for 2008, the Qualified Optional Survivor Annuity or
QOSA. For plans subject to the qualified joint and survivor
annuity rules, this is an option that needs to be made available
as a survivor annuity.

available online on retirement plan and IRA subjects.
